By subscribing to TUDCLOUD (hereinafter referred to as “we”), you (the client) agree to comply with our Terms of Service. TUDCLOUD reserves the right to cancel, suspend, or terminate any service (subscription) at any time, with or without a refund, notice, or warning, at our sole discretion. TUDCLOUD also reserves the right to modify these Terms of Service at any time, with or without prior notice to clients. Clients are responsible for regularly reviewing and familiarizing themselves with the latest Terms of Service. If a client does not comply with the updated Terms of Service, their service may be terminated immediately.


Payment, Refund, and Cancellation Policy

  • All invoices are generated 7 days prior to the due date. Failure to pay before the due date will result in service suspension until payment is received.

  • Services not paid within 5 days after the due date will be terminated, and TUDCLOUD is not responsible for any data loss caused by such termination.

Refund Policy:

  • TUDCLOUD offers a 24-hour refund guarantee (from the time of payment) for new users on their first order of VPS, Web Hosting, or DDoS Protection services.

  • Dedicated Server products are not eligible for refunds.

  • Refunds may be denied if the user violates the Acceptable Use Policy (AUP) or engages in abuse (e.g., excessive support requests, spam).

  • Refunds apply only to new accounts with a first-time order. Existing users with previous subscriptions are not eligible for refunds.

  • Refund requests must be submitted through a billing ticket. Requests made by any other method are invalid.

  • All refunds are subject to deduction of payment gateway fees (typically $0.30 plus up to 5% of the payment amount).

  • Chargebacks or disputes will be treated as fraud, resulting in immediate suspension or termination of services and forfeiture of any refund eligibility.

Clients agree that they remain fully liable for recurring payments and renewals of all active services until a cancellation request is submitted through the billing panel. Merely leaving an invoice unpaid does not constitute cancellation.


Account and Service Transfers

  • Clients are not permitted to change account ownership information (such as name or email) without explicit approval from TUDCLOUD. Unauthorized changes may result in suspension or termination.

  • Services may be transferred to another account/user upon request via billing ticket, subject to a fee of $5 per service.


Service Level Agreement (SLA)

  • TUDCLOUD aims to provide 99.9% uptime, but this is not guaranteed.

  • If uptime falls below 99.9%, clients may request SLA credit: one day of service credit for each hour of downtime (up to a maximum of one month’s recurring charge). Credits are issued as account credit only.

  • SLA claims must be submitted via billing ticket within 7 days of the outage.

  • We reserve the right to deny SLA claims at our discretion.

  • TUDCLOUD shall not be held liable for any damages or losses under any circumstances.


Network Performance

We make every effort to optimize our network but cannot guarantee performance for all regions. For example, international routing to/from China may be unstable due to restrictions outside of TUDCLOUD’s control. Clients may open a support ticket to request route optimization.


Data Backups

TUDCLOUD does not provide any form of guaranteed backup. Clients are fully responsible for maintaining their own backups externally. We are not liable for any data loss or financial loss under any circumstances.


Client Responsibility

  • Clients are fully responsible for the usage of their accounts, including any admins or sub-users they authorize.

  • TUDCLOUD is not responsible for any disputes, conflicts, or damages caused by account or file sharing.

  • Clients are solely responsible for any files they upload or store, including copyrighted material.


Acceptable Use Policy (AUP)

The following are strictly prohibited on all services:

  • Illegal adult content

  • Spam or bulk/marketing email (unless pre-approved)

  • Phishing, malware, trojans, viruses

  • DDoS/DoS attacks, port scanning, traffic exchange

  • Cryptocurrency mining, high disk I/O operations

  • TOR exit nodes

  • Unauthorized copyrighted material

  • Any activity illegal under Chinese, U.S., or U.K. law

  • VPS: sustained high CPU, I/O, or network usage that negatively impacts other clients

Violations will result in suspension or termination of services, with or without notice.


Abuse Complaints

If we receive an abuse complaint (including DMCA notices), it will be forwarded to the client. The client must respond and resolve the issue within 24 hours, otherwise the service port will be suspended. Continued abuse may result in permanent termination of the service.


Bandwidth and Resource Limits

  • Dedicated Servers: Exceeding 110% of allocated bandwidth will result in port suspension until a bandwidth upgrade is purchased.

  • VPS: Once allocated bandwidth is exceeded, the connection will be limited to 5Mbps unmetered until the next billing cycle. Ports are shared gigabit; sustained traffic above 50,000 pps is prohibited.

  • CPU Usage: A VPS may not use more than 50% of allocated cores for longer than 1 hour.


DDoS Protection

  • Hong Kong/US nodes include 20Gbps TCP protection by default (upgrades available).

  • Any intentional DDoS testing, abuse, or encouraging attacks against our network will result in immediate suspension or termination.


Colocation

  • Equipment will not be returned if invoices remain unpaid.

  • Clients are responsible for shipping fees and de-racking/packaging costs when requesting equipment return.


Affiliate Program

  • VPS, Web Hosting, and DDoS Protection: 15% commission

  • Dedicated Servers: 1% – 5% commission

  • Commissions are confirmed only after the referred service has been active for 60 days without refund.

  • Withdrawals are available once the balance reaches $50.

  • Fraud or abuse will result in denial of commission and permanent disqualification from the program.
